1. Agreement
By signing up for or using Digital Hokage Cloud services, you agree to these Terms. If you do not agree, do not use the service.
2. Service Description
We provide shared, reseller, VPS-style, and developer cloud hosting on infrastructure located in India. Plans and features are described on our pricing page.
3. Account
- You must be 18+ and provide accurate registration information.
- You are responsible for keeping your password and API tokens secure.
- You are responsible for all activity under your account.
4. Acceptable Use
You may NOT use Digital Hokage to host or transmit:
- Spam, phishing, malware, crypto-mining, or DoS tools
- Child sexual abuse material (CSAM) — zero tolerance, instant suspension + report
- Content that infringes copyright or violates Indian law (IT Act 2000, IPC, etc.)
- Resource-abusive workloads on shared plans (continuous high CPU, fork bombs, public proxies)
- Adult/escort content, gambling sites without lawful licensing, or hate-speech content

5. Billing & Renewals
- Plans are billed in advance — monthly, annually, or as displayed at checkout.
- All prices are in INR and inclusive of GST where applicable.
- Auto-renewal can be disabled anytime from the client portal.
- Failure to pay within 7 days of due date may result in suspension; 30 days, termination.
6. Refunds
Governed by our Refund Policy — 7-day money-back on first-time hosting orders.
7. Uptime SLA
We guarantee 99.99% network uptime per calendar month. If we miss it, you may claim a service credit equal to 5% of monthly fees per 0.1% below SLA, up to 100% of that month's fee. Claims must be filed within 30 days.
8. Backups
We maintain 7-day rolling backups as a courtesy. You remain responsible for maintaining your own off-site backup copies.
9. Limitation of Liability
To the maximum extent permitted by Indian law, our total liability is capped at the fees you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, data loss, business interruption).
10. Termination
Either party may terminate with 7 days' notice. We may suspend immediately for violations of Section 4. Upon termination, your data is deleted within 30 days.
11. Governing Law
These Terms are governed by the laws of India. Exclusive jurisdiction lies with the courts at Chennai, Tamil Nadu.
12. Changes
We may update these Terms with 14 days' notice via email. Continued use after the effective date constitutes acceptance.
